Under a Denver Sales and Use Tax Audit?

You’ve received a Notice of Audit from Denver. Now what?

A Denver Sales Tax audit is really an audit of all applicable tax types. Commonly this will include Sales Tax, Use Tax (Use tax is tax due when a vendor didn’t charge you sales tax), Occupation Privilege Tax (“OPT”), Lodger’s Tax and Business Personal Property Tax and others taxes.

Denver is actually “The City and County of Denver”. Since Denver is a home-rule jurisdiction, they administer their own sales and use tax laws which are distinct and separate from Colorado State. As a combined City and County, Denver also administers Business Personal Property Tax.

I’ve defended clients under a Denver audit, but I interviewed a Denver Sales Tax Audit Supervisor to get a more thorough answer that includes the City’s perspective and problematic areas they see.
